FREQUENTLY ASKED QUESTIONS

WHAT DOES LGPD MEAN?

LGPD is the acronym for the General Data Protection Law (Law No. 13,709/2018), enacted in August 2018. The LGPD establishes rules for the collection, storage, processing, and sharing of personal data, providing greater protection to data subjects and imposing penalties for failure to comply with its requirements.

WHAT IS PERSONAL DATA?

This is information relating to a living person, such as their name, phone number, email address, and personal documents. Personal data also includes a set of distinct pieces of information that may lead to the identification of a particular person.

WHAT IS SENSITIVE DATA UNDER THE LGPD?

Under the LGPD, sensitive data refers to data connected to a person's private life and therefore subject to greater protection. Sensitive personal data includes information: (i) about racial or ethnic origin, (ii) religious beliefs, (iii) political opinions, (iv) membership in a labor union or organization of a religious, (v) philosophical, or political nature, (vi) related to health or sex life, and (vii) genetic or biometric data, when linked to a natural person.

WHO IS THE DATA SUBJECT?

The data subject is the owner of the personal data. This is the natural person, identified or identifiable, to whom the data relates.

WHAT IS DATA PROCESSING?

Data processing means any activity performed with personal data, such as storing, viewing, operating, transmitting, sharing, and accessing it.

WHO DOES THE LGPD APPLY TO?

The LGPD applies to any individual or legal entity, public or private, that processes data, except for personal and non-economic purposes, journalistic, artistic, or academic purposes, public and national security, national defense, and criminal investigation.

WHY IS A LAW NEEDED TO PROTECT PERSONAL DATA?

The LGPD establishes minimum standards to be followed when using personal data, such as limiting its use to a specific purpose, creating a safe and controlled environment for its use, and other measures, always with the aim of ensuring that citizens who are data subjects play a leading role in fundamental decisions regarding this matter.

WHAT CHANGES WITH THE LGPD?

Already in effect, the LGPD (General Data Protection Law) brings significant changes to corporate environments. From now on, all businesses need to strengthen data security and implement more transparent policies regarding its use, collection, and storage.
